Policies

Business Hours are from 8:00 a.m. to 5:00 p.m. (EST), Monday through Friday. Acceptance and delivery of all purchase orders is expressly conditioned upon the satisfaction of all past due accounts with us and are subject to management approval.

Terms & Conditions

1. The sale of the goods covered by this invoice is subject to all terms and conditions printed on both sides of this invoice. This invoice must be accepted according to the terms stated herein. If no notification is given to the Company within five days after receipt if this invoice, or if delivery is accepted on any part of the goods covered by this invoice, it is understood that the terms and conditions of this invoice are satisfactory to and are accepted by Purchaser. Unless specifically agreed to in a writing signed by the Company, purchase orders, confirmation memorandum or other writing may not vary the terms of this invoice.

Shortages

1. Any claims for shipments having shortages must be made immediately upon receipt of order to our Customer Service Department. Packaged received with notable damage should be opened for inspection of products and must be reported immediately to SublimationToner.com. (800-866-3799)

Warranties

1. THE SALE OF THE GOODS PURCHASED FROM SUBLIMATIONTONER.COM IS MADE ON THE EXPRESS UNDERSTANDING THAT THERE IS NO IMPLIED WARRANTY OF MERCHANT ABILITY OR IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THE PURCHASER ACKNOWLEDGES THAT HE IS NOT RELYING ON THE COMPANY'S SKILL OR JUDGEMENT TO SELECT OR FURNISH GOODS SUITABLE FOR ANY PARTICULAR PURPOSE AND THAT THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF OR SET FORTH ON THE PRODUCT PACKAGING, IF ANY.

2. If Purchaser determines in its good faith judgment that all or any part of a shipment contains defective goods and notifies the Company of such determination within two weeks of the receipt of the product, the Purchaser shall be obligated to return such goods to SublimationToner.com within 30 days and SublimationToner.com may, in its sole discretion, if it determines the goods are defective, replace the goods, repair the goods or issue store credit. No cash refunds will be given. No returns will be accepted without a copy of an Original Invoice Number, Invoice Date and RMA Number. All returns are subject to SublimationToner.com guarantees.

3. The cost of returning all rejected goods will be the obligation of the Purchaser. If SublimationToner.com replaces or makes conforming any rightfully rejected goods, the cost of shipping the new or conforming goods shall be paid by SublimationToner.com. Non-defective items that are returned must be in re-saleable condition and if accepted a 20% restocking fee will apply. All returns must have a Return Merchandise Authorization Number (RMA) or shipment will be denied by SublimationToner.com.

Limitation of Liability

1. SublimationToner.com's liability for breach of or arising out of the sale of any goods shall be limited to the purchase price of the goods. In no event shall SublimationToner.com be liable for any special, consequential, incidental, indirect or other damages (including without limitation loss of profit) whether or not SublimationToner.com has been advised of the possibility of such loss, however caused, whether for brach or repudiation of contract, breach of warranty, negligence, failure to deliver or under any other theory of liability.

2. SublimationToner.com shall not be liable for any losses or damages due to causes beyond its control, including without limitation supplier delays or shortages, fire, flood, earthquake, tempest, labor dispute, war, act of God, embargo, civil commotion or government regulation. In the event of any delay due to such causes beyond SublimationToner.com's control, the delivery date will be deemed extended for a period equal to the delay, or SublimationToner.com may, as its option, cancel all or any part of undelivered orders or unfilled parts thereof.

Delivery and Payment

1. Delivery of all goods shall be F.O.B KLE's facility, unless other arrangements are agreed to by both parties prior to shipment. Title to the goods and risk of loss and damage shall pass to the Purchaser at the F.O.B. point.

2. Unless otherwise agreed by both parties, payment for the goods shall be made prior to shipment or no later than thirty (30) days following the date of invoice for purchaser's with approved credit accounts.

3. SublimationToner.com retains a purchase money security interest in the delivered goods until SublimationToner.com receives payment in full or for the goods. If SublimationToner.com deems in good faith that the credit of the Purchaser is impaired, SublimationToner.com may, in its sole discretion, require payment in advance for the goods or cash on delivery. All C.O.D. shipments must be paid with certified funds unless prior approval is granted.

4. Unless otherwise agreed by the parties or unless Purchaser provides SublimationToner.com with a valid resale certificate, Purchaser shall pay all sales, use and other taxes in connection with the goods when required.

Pricing

SublimationToner.com reserves the right to update prices, product specifications and policies at anytime without notice.

Cartridge Exchange Policy

To be able to offer our customers excellent pricing and quality; to help alleviate the ecological pressure on our landfills, we require the return of a used empty cartridge at our expense for every one we sell except, the color sticks and the MICR cartridges.

We will provide an Authorization Return Services (ARS) label at anytime. We appreciate having a returned cartridge within 30 days of the order. If this is a problem, please contact us to make alternate arrangements.

Some customers have extra cartridges. If we can use them, we will give credit for approved extra returned cartridges per market value.

We are happy to give Credit on accounts for authorized returns; however, we do not give cash refunds.
